Neutral, Informed, and Practical Mediation of Employment Disputes

Peter Massaro offers employment law mediation services through Massaro Employment Law LLC. Pete has represented both employees and employers, and he has served as a neutral decisionmaker. Thus, Pete has seen employment disputes from every angle and brings this broad perspective to the mediation process. Pete’s experience allows him to understand not only the legal standards that apply to employment claims, but also the practical considerations that influence how parties evaluate risk, evidence, and potential resolutions.

As an EEOC administrative judge, Pete conducted many mediations in which the employee was proceeding pro se. Pete, therefore, is adept at explaining employment law concepts in a clear, accessible manner; ensuring that unrepresented parties understand the process and their options; helping parties realistically assess litigation risk and settlement value; and maintaining fairness and procedural balance in mediations involving represented and unrepresented participants.

Pete’s mediation approach reflects his experience as a judge, advocate, and advisor. He works to ensure that all parties – whether represented by counsel or proceeding pro se – understand the governing law, the evidentiary issues, and the practical considerations that affect resolution. His goal is not to pressure outcomes, but to facilitate informed, meaningful discussions that allow parties to reach durable resolutions when possible.

Rates for Mediation Services via Videoconference

Pete provides mediation services via videoconference at the following rates:

  • 3-hour session: $1,000
  • 8-hour session: $2,400

Full fee is incurred at start of scheduled session.

Pete also provides mediation services via videoconference on an hourly basis at a rate of $400 per hour. A 3‑hour minimum applies to all mediations.

Stated rates are NOT per party, but rather are the TOTAL rate for the corresponding amount of time. Pete does not charge administrative fees or any other fees outside of the rates stated above.

Rates for Pete to provide mediation services in-person are available upon request.

Fee Allocation and Payment Terms

  • Mediation fees are split among represented parties in whatever manner upon which the attorneys agree.
  • When only one party is represented, the attorney/firm representing that party is responsible for the entire mediation fee.
  • The contract for mediation services is with the attorney/firm, not the client.
  • No fees are due until after services are rendered or cancellation fee (see below) is incurred because Massaro Employment Law LLC relies on the attorney’s and/or firm’s credit.
  • Although an attorney or firm may seek reimbursement from their client, payment is expected from the attorney/firm regardless of client activity.

Cancellation Policy

  • No cancellation fee if the mediation is canceled at least 10 days before the scheduled mediation date.
  • $500 cancellation fee if mediation is canceled less than 10 days, but more than 72 hours before the scheduled start time.
  • $1,000 cancellation fee if mediation is canceled within 72 hours of the scheduled start time.
